Terms and conditions


ARTICLE 1: APPLICATION OF THE GENERAL CONDITIONS OF SALE (CGV)

These General Conditions of Sale (CGV) apply to the reservation made by the Customer. These General Terms and Conditions are available to Customers on our website. Any reservation therefore implies full and unreserved acceptance by the Customer of these conditions.


ARTICLE 2: ORGANIZATION OF THE RESERVATION

For all Customers, reserved rooms are made available from 4 p.m. on the day of arrival. They must be vacated no later than 10 a.m. on the day of departure, any delay beyond this may result in the billing of an additional night at the posted public rate.


1/ Reservations can be made directly on site, by mail, by e-mail or by telephone. Except last minute, this method of reservation is subject to confirmation by Chalet Pink. If the reservation is made on our partners' sites, or directly with one of our partners, no confirmation from Chalet Pink is sent to the customer.

2/ For the reservation to be final, last minute reservation or not, the customer must pay a deposit, i.e. 30% of the total amount of the stay (excluding tourist tax and catering), BEFORE arriving at the chalet, exceptions made for reservations made through our partners.

• - If the reservation is made on the Chalet Pink website, the chalet contacts the Customer by email or telephone in order to pay the deposit.

• - If the reservation is made on the website of one of our partners, Chalet Pink retrieves the bank details transmitted by the Customer on the site. In this aforementioned case, Chalet Pink undertakes to only use these contact details in the event of cancellation as specified in Article 3 of these General Terms and Conditions.

• - If the reservation is made directly with one of our partners, the latter sends Chalet Pink a written confirmation of the reservation with the Customer's information without payment of a deposit or transmission of bank card details.


ARTICLE 3: CANCELLATION

As invoicing is made on the basis of the services ordered for the entire stay, the Customer is invited to pay the greatest attention to the cancellation conditions defined below.

1/ Are considered as cancellation:

• The change of dates of the reservation,

• Failure to pay contractual installments,

• Oral or written warning of the Client's non-arrival for personal reasons,

• The non-arrival of the Client without warning,

• Breach of Chalet Pink rules.

2/ Cancellations of all or part of the initial reservation must be accepted in writing by Chalet Pink which, however, may without any reason refuse the request for modification of services. In the absence of written acceptance from the establishment, the reservation is maintained in the initial terms and Chalet Pink cannot be sought for payment of any compensation.

3/ Any stay booked or started at Chalet Pink is due in full in accordance with the reservation made by the Customer. No reduction or discount will be made in the event of non-arrival or early departure, at the initiative of the Customer, whatever the reason (except exclusions below, article 3).

5/ Cancellation deadlines:

If the cancellation is made more than 10 days before the start of the stay, the entire deposit paid is returned to the Customer. From 10 days until the start date of the stay, the deposit is kept by the Hotelier and permanently lost for the Customer.

6/ Exclusions to the application of the cancellation conditions:

• Death of a family member: a death certificate and proof of family relationship must be provided,

• Hospitalization of the client or a member of his family: an admission certificate from the hospital specifying the reason for admission must be provided,

• Major loss at the customer's main home (fire, destruction, burglary): proof to be provided.


ARTICLE 4: REMOVAL

In the event of unavailability of the establishment, in the event of force majeure, a technical problem in the chalet or for any other reason, the chalet reserves the right to accommodate the Clients totally or partially in accommodation of equivalent category. for services of the same nature. The Hotel cannot be sought in payment of any additional compensation.


ARTICLE 5: PRICE

Prices are expressed in Euros. The applicable rates are those in effect on the day the reservation is made. Prices are increased by tourist tax. They may be modified in the event of a legislative and/or regulatory change likely to result in price variations such as: modification of the applicable VAT rate, introduction of new taxes, etc. The VAT rate applied is the rate in effect on the invoice date. In any case, if the reservation (number of rooms, and/or meals) turns out to be at least 10% lower than the initial reservation, the Customer could be allocated new rates due to the reduced services.


ARTICLE 6: PAYMENT TERMS

1/ Deposit

For individuals and groups, it must be paid either remotely by telephone by credit card, or by mail by bank check, or by transfer directly to Chalet Pink's bank account. In the case of a reservation on the sites of our partners for which payment cannot be made online, the bank card details are collected by Chalet Pink which undertakes to only use them in the event of cancellation as specified in article 3: Cancellation.

2/ Balance

For a room, it must be paid at the latest the day before departure as well as the tourist tax and any additional consumption and/or services requested by customers during their stay. Cash and bank cards (Visa, Mastercard) are accepted.

3/ Failure to pay

In the absence of payment on the contractual due date, late payment penalties will be due the day after the due date of the invoice at the rate of 15% per year, applied to the total amount including tax of the invoice. In addition, a fixed compensation amounting to €40 excluding tax per debt will be due the day after the due date of the invoice to which will be added additional compensation to cover all costs incurred in the event of disputed recovery. . It is recalled here that any payment occurring beyond 60 days from the date of issue of the invoice is legally considered to be an abusive practice and punishable under criminal law. In addition, any failure to pay on the contractual due date will make all debts remaining due by the Client for invoices issued by Chalet Pink immediately due and payable, and will result in the modification of the payment terms, i.e. the Client must prepay any new reservation request until full payment of debts owed to Chalet Pink.


ARTICLE 7: TRANSPORT

It is specified that Chalet Pink does not provide any transport-related services. It can therefore under no circumstances be held responsible for problems linked to the transport of Customers (delay, cancellation, etc.).


ARTICLE 8: FAILURES, DAMAGE BY THE CUSTOMER

The Client accepts and undertakes to use the room and the chalet in a good manner. Also any behavior contrary to good morals and public order will lead Chalet Pink to ask the Customer to leave the establishment without any compensation and/or without any reimbursement if payment has already been made.

1/ Additional person:

The Client undertakes not to bring additional people without the express authorization of Chalet Pink, and not to sublet the accommodation. Otherwise, Chalet Pink authorizes itself to refuse the rental of the room and/or chalet and to keep the deposit.

2/ Access to the Wellness area, Nordic bath, ski room, lobby:

The Client undertakes to respect the Internal Regulations for the use of the aforementioned services; Furthermore, use by minors is under the full responsibility of parents or legal representatives.

3/ Connection and use of the Chalet Pink WiFi network

The Customer undertakes to use the establishment's WiFi network in a good manner and to satisfy the measures included in the law of 2001 relating to daily security as well as the law of 2006 relating to the fight against terrorism, and law no. 2009-1311 relating to the criminal protection of literary and artistic property on the internet, called “HADOPI 2”. Concretely, Chalet Pink will retain the following elements to be able to provide any person authorized by law, for a period of 1 year after the fact:

  • the MAC addresses of all equipment that had access to the establishment's WiFi,
  • the date, time and duration of each communication,
  • technical information to identify the user by their connection logs (IP addresses, etc.) and,
  • technical information allowing the identification of the recipient(s) of the communication.


ARTICLE 9: INSURANCE-DAMAGE-BREAKAGE-THEFT

The Client certifies having taken out civil liability insurance to cover any damage that may be caused in the establishment during the period of their stay.

The Customer must ensure safekeeping of the goods and materials brought by him/herself. He is particularly invited to take out specific insurance in the event of the presence of large equipment or valuable goods to the extent that the establishment cannot be held liable in the event of damage or theft of said goods.

The Customer is responsible for all damage caused by himself and undertakes, in the event of damage to the premises made available, to bear the costs of restoring these premises. Under no circumstances can the establishment be held responsible for damage of any nature whatsoever, in particular fire or theft, likely to affect objects or materials left by the Customer during accommodation.

Likewise, any parcel, package, etc. delivered to Chalet Pink before and during accommodation may be received by reception during opening hours but under no circumstances will the latter be responsible for any incident, any deterioration, incorrect number of packages, damaged packages, any problem of delivery. The Customer undertakes in the event of a problem to contact the supplier or carrier directly.

The Client and its insurers waive all recourse against Chalet Pink, its staff and its insurers due to any direct or indirect damage resulting from the total or partial destruction of all materials, movable objects, fittings, any valuables, goods, as well as the deprivation or disturbance of enjoyment of the premises.


ARTICLE 10: ANIMALS

Animals are not allowed in our “Chalet Pink” guest house. Any Customer who arrives accompanied by an animal will be refused access to the chalet and the cancellation conditions of article 3 will be applied to them.


ARTICLE 11: TOBACCO:

Smoking is strictly prohibited in rooms and common interior spaces in accordance with the law of January 2, 2008. However, we invite you to use the dedicated outdoor spaces.


ARTICLE 12: RESPONSIBILITY

Chalet Pink cannot be held responsible in the event of changes to the structure of any nature whatsoever: transfer of establishment, closure of establishment, etc. The photos presented on the website are not contractual. Even if all the best efforts are made so that the photographs, graphic representations and texts reproduced to illustrate our guest house presented give as accurate an overview as possible of the accommodation services offered, variations may occur, in particular due to the change of furniture or possible renovations. The Customer cannot claim any claim as a result. Chalet Pink will not incur any liability for any indirect damage as a result of this, in particular operating loss, caused by third parties, caused by the Client or caused by its partners.


ARTICLE 13: FORCE MAJEURE

The obligations contained herein will not be applicable or will be suspended if their execution has become impossible due to a case of force majeure such as: act of public authority, hostilities, war, act of the Prince, natural disaster, fire, flood , strikes without notice, pandemic etc. The parties must make every effort to prevent or reduce the effects of non-performance of the contract caused by a force majeure event; the party wishing to invoke a force majeure event must immediately notify the other party of the beginning and end of this event, otherwise it cannot be released from its liability.


ARTICLE 14: MODIFICATION

These General Terms and Conditions may be modified at any time. In this case, Chalet Pink will transmit the modifications to the Client before the start of the services. From then on, the new version of the General Conditions of Sale will apply to the relations between the parties.


ARTICLE 15: PARTIAL NULLITY

The nullity of one or more articles of these General Terms and Conditions will not result in the nullity of all of them. All other stipulations herein will remain applicable and will produce all their effects.


ARTICLE 16: COMPLAINTS AND DISPUTES

In the event of a dispute, complaint or disagreement over part of the invoice, the Customer undertakes to pay the undisputed part without delay and to indicate in registered writing the establishment concerned, the reason and the amount of the dispute, in a period of 7 days from the date of end of accommodation. After this period, the service and invoicing are considered accepted and cannot give rise to any subsequent complaints from the Customer. In the event of a dispute, and in the absence of an amicable agreement, the competent courts will be those of the head office of the company operating the establishment.


ARTICLE 17: APPLICABLE LAW

The applicable law is French law.


ARTICLE 18: ELECTION OF DOMICILE

All written communications between the parties (letters, notifications, email, etc.) must be sent for the guest house to its postal or electronic address, and for the Client to the postal or electronic address indicated in the reservation.


ARTICLE 19: ANNEXED SERVICES

The services offered by the Hotel such as package reservation or equipment rental are governed by the conditions of sale of the service providers concerned.


ARTICLE 20: DEFINITION OF THE PARTIES

The company Alpine Pink Lodge Sarl is registered in the Metz Trade and Companies Register under RCS number 809 764 673 with VAT number FR 35 809 764 673. In its accommodation activities it acts under the name “Chalet Pink ".


ARTICLE 21: SECURITY AND CONFIDENTIALITY POLICY

Securing entrances

Customers will be given an electronic badge and/or an electronic code via the Tapkey application to download before entry in order to be able to open and close the electronic locks opening to the common areas. The customer therefore authorizes his personal email to be transmitted to the Tapkey company which manages access on its dedicated platform. Any additional information can be obtained directly on tapkey.com and/or during the free subscription to the service. Electronic badges and traditional keys must be returned upon departure. In the event of loss of the electronic badge, it will be charged 20 euros per unit.

Video surveillance

External cameras at the entrance ensure everyone's safety, customers confirm that they are not opposed to this measure, for the good of all customers and staff.


General Data Protection Regulation, law of May 25, 2018

The information collected on our forms is recorded in a computerized file by our manager or his delegate(s) in order to ensure the provision of accommodation services and the security of our customers.

Only customer emails will be communicated to the Tapkey company in order to allow the management of electronic badges. The data is kept for 10 years.

Video surveillance images are stored locally on hard drive for a period of 8 days.

You can access the data concerning you, rectify it, request its erasure or exercise your right to limit the processing of your data.
